% 03.03.2017 Petitioner is facing trial in a case arising out of the FIR No. 73/2014 under Sections 354/506 IPC and Section 8 of the POCSO Act registered at P.S. Badarpur. Prosecutrix alleged in the FIR that petitioner was stalking and teasing her for the last one year. On 7th February, 2014 while she was returning from the school, petitioner abused her at the intersection of B.I.W. Colony and Gautampuri and caught hold of the hand of prosecutrix. He also threatened the prosecutrix that he would kill her family members if she did not talk to him.
Petitioner was arrested on 8th February, 2014. He was admitted to bail on 7th March, 2014. However, during the trial, petitioner
did not attend the Court and non-bailable warrants were issued against him. Pursuant to the non-bailable warrants, petitioner was arrested on 12th August, 2016. Petitioner is in custody for about seven months. Trial is in progress.
Keeping in mind the totality of circumstances, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
