CM(M) 83/2017 After some argument, the learned counsel for the petitioners seeks to withdraw the present petition with liberty to agitate his contention that the suit being CS(OS) No.1359/2014 is barred under Order 2 Rule 2 CPC before the appropriate court.

Granting leave and liberty to make his submission as per law, the present petition is dismissed as withdrawn.
