On 29.11.2017, the petition was dismissed for non-prosecution. However, by order dated 02.04.2018, the petition was restored. The contention of the learned counsel for the respondent was noted that the petitioner impugned order dated 05.05.2016, which was an adinterim order and the Trial Court, by order dated 03.06.2017, had fixed interim maintenance and the petition had become infructuous. Learned counsel for the petitioner had sought an adjournment to take instructions.
