CRL.M.C. 3268/2017 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.123/2017, under Sections 323/324/341/34 IPC, registered at Police Station Karol Bagh, Delhi and all proceedings emanating therefrom. Learned counsel for the petitioners has submitted that the petitioners and the respondents No.2 & 3 are having the business at Karol Bagh where they are neighbours and due to the business rivalry, a misunderstanding has arisen between them which resulted into the registration of the aforesaid FIR against the petitioners. Counsel further submits that after the registration of
the FIR, the near relatives and the business friends intervened and the misunderstanding has been sorted out and the dispute has been amicably settled/resolved between the parties and the same has been reduced into writing vide settlement deed dated 17th May, 2017 and further submits that nothing further remains to be adjudicated between the parties, however, the present FIR is coming as hurdle in the peaceful life of the petitioners and prays that the FIR and all subsequent proceedings arising of the same may be quashed.
The respondents No.2 & 3 are present in Court today and have been identified by the Investigating Officer SI Jagrup Singh, P.S. Karol Bagh, Delhi and also represented by their counsel. The respondents No.2 & 3 present in person admit the factum of amicable settlement with the petitioners and execution of settlement agreement on 17th May, 2017. They further admit that the said settlement with the petitioners is voluntary and without any force, pressure or coercion and further submit that they have no objection if the FIR is quashed.
Looking into the above facts and circumstances, since the misunderstanding has been sorted out and the matter in dispute has been amicably settled between the parties and the same has been reduced into writing on 17th May, 2017 and nothing further remains to be adjudicated between the parties, to have peace in the life of both the parties and to upkeep better business relations between them in present and in future and to meet the ends of justice, I deem it appropriate to quash the present FIR and all proceedings arising therefrom.
Consequently, FIR No.123/2017, under Sections 323/324/341/34 IPC, registered at Police Station Karol Bagh, Delhi and all proceedings
emanating therefrom are hereby quashed. Parties shall remain bound by the terms of settlement deed dated 17th May, 2017. The present petition is allowed and disposed of accordingly. Copy of the order be given dasti to the parties, as prayed. I.S.MEHTA, J AUGUST 21, 2017 'dc'
