% 20.01.2016 The petitioner has filed the present petition under Section 9 of the Arbitration and Conciliation Act, 1996 for interim measures. By order dated 6th October, 2015, the interim order was passed directing the respondent to maintain status-quo with regard to the sale of the first floor of the Prabhatam Grand Mall, Dhanbad. Yesterday, when the matter was taken up, the suggestion was given on behalf of the petitioner that the petitioner has invoked the arbitration clause and is inclined to adjudicate the disputes between the parties. The names of the proposed Arbitrators were given by the learned counsel for the petitioner to the learned counsel for the respondent and the matter was listed for today.
When the matter is taken up today, after obtaining the instructions from the respondent, the counsel for the respondent has agreed to the name of Mr.Zisan Alam Siddqui, Advocate, 6, LGF,
Vikram Vihar Extension, New Delhi-110024 as Arbitrator. As agreed, said Mr.Zisan Alam Siddqui, Advocate is appointed as sole Arbitrator to adjudicate the disputes arising out between the parties as mentioned in the present petition, including their claims and counter-claims. The arbitration shall take place under the aegis of Delhi International Arbitration Centre ('DAC').
The fees of the learned Arbitrator shall be in terms of the Delhi International Arbitration Centre (Administrative Cost Arbitrator's Fees) Rules. With the consent of the parties, the present petition is disposed of, as the learned counsel for the respondent has no objection if the interim order passed on 6th October, 2015 is made absolute during the pendency of the proceedings. Ordered accordingly. Copy of this order be given dasti to the learned counsel for the parties and a copy thereof be communicated to the learned Arbitrator as well as Additional Coordinator, DAC forthwith.
