The instant petition under Sections 397 and 401 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 482 of the Code of Criminal Procedure, 1973) has been filed on behalf of the petitioner seeking the following reliefs:

"1. To set aside and quash the impugned Order dated 28.01.2016 passed by the Ld. Trial Court framing charges against the petitioner u/s 8, 22 r/w 29 of NDPS Act;

2. To set the petitioner at liberty forthwith as remaining charges do not attract section 37 of the NDPS Act; AND

3. To pass any other order(s) in favour of the petitioner which this Hon'ble Court may deem fit and proper in order to meet the ends of Justice. "
