1. For the reasons stated in the application, the delay in filing the appeal is condoned. The application is disposed of. LPA 565/2018 & CM APPL 41143/2018 (stay)

2. The Court notes that judgment in the writ petition was first reserved by the learned Single Judge on 22nd August 2017. Thereafter, it was again reserved for judgment on 17th January 2018 and 9th August 2018.

3. The order dated 5th October 2018 passed by this Bench in the present appeal was placed before the learned Single Judge on

11th October 2018. After perusing the said order, the learned Single Judge passed an order, the relevant portion of which reads as under: "Vide order dated 05.10.2018, the matter in relation thereto is thus subjudice before the Hon'ble Division Bench for the date 26.10.2018, in view thereof, the matter be re-notified for the date 01.11.2018".

4. In view of the above order, this Bench is assured that the learned Single Judge will now proceed to pronounce the orders on the date fixed.

5. The appeal and the application are disposed of. A copy of this order be placed by the Registry before the learned Single Judge forthwith.
