% 28.12.2016 It is the petitioner's case that the requisite installation has been done as per their agreement with the respondent and the project is complete. Indeed, all that remains to be done is the commissioning and testing for defects, which would be done in the next three weeks or so.
Mr. Samit Khosla, who appears on behalf of the respondent on service of advance copy of the petition, states upon instructions from Mr. Rama Kant, authorised representative of the respondent, who is present in Court, that they will keep in abeyance their letter of termination of the contract with the petitioner for the next four weeks, provided the petitioner completes the project in the interim. In view of the above, the petition is disposed off with the
direction that without prejudice to the respective rights and contentions of the parties the petitioner will complete its remaining obligation as aforesaid in four weeks hence.
The counsel for the parties state that even otherwise they shall try to amicably settle any disputes they may have.
