% 21.08.2017 It is stated by the counsel appearing for the IIT on advance notice that pursuant to the meeting held on 11.08.2017, the subject tender has been recalled in view of the decisions taken. The original tender file which contains the Minutes of the said meeting is produced in the Court. Having considered the same, this Court is of the opinion that the claim in these proceedings had been rendered infructuous. At the same time, the Court notices that the tender process which was recalled was second in the series of bids invited for the purpose of running the canteen in the IIT.

In these circumstances, the respondent IIT is directed to ensure that the finalized fresh tender/NIT is published within three weeks and every endeavour is made to complete the process of tender within four weeks thereafter.
The writ petition is disposed of but in the above terms. Order dasti.
