The petitioner has approached this Court under Article 226 of the Constitution of India read with Section 482 Cr.P.C. for modification of order dated 6th June, 2017 by which Director General of Prisons had granted him first spell of furlough for a period of three weeks, subject to his furnishing a personal bond in the sum of Rs.20,000/- with two sureties in the like amount to the satisfaction of the Superintendent, Central Jail No.2 Tihar, apart from the other conditions.

The petitioner had moved the authority who granted him the furlough with a request for modification of the terms with regard to furnishing of two sureties which was rejected by the Director General of Prisons by order

dated 1st July, 2017.

It is pointed out that the present petitioner in W.P. (Crl.) 274/2017 by order dated 3rd February, 2017 was released on parole for a period of one month from the date of his release, subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the Jail Superintendent.

In the circumstances, when the was earlier released on parole with the condition of furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount and he did not violate the said order, the orders dated 6th June, 2017 and 1st July, 2017 are modified to the extent that the petitioner be released on furlough for a period of three weeks from the date of his release, subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety in the like amount. The other terms and conditions mentioned in order 6th June, 2017 shall remain the same. 5.

The petition is disposed of.
