IA No.1497/2018 (of the parties under Order XXIII Rule 3 of the CPC). 3.

The parties in this suit for recovery of Rs.3,40,30,508/- were vide order dated 5th January, 2018 referred to the Mediation Cell of this Court. 4.

Mediation has been successful with the efforts of Mr. Mohit Gupta, Advocate/Mediator and a copy of the Settlement Agreement dated 17th January, 2018 purporting to be signed by the parties, their Advocates and by the Mediator has been filed along with this application. 5.

The counsel for the plaintiff and the counsel for the defendant support the application.

Though in Clause I (j) of the Settlement Agreement the parties have agreed to withdrawal of the present suit but the counsel for the plaintiff CS(OS) 385/2017

seeks a decree in terms of the compromise.

7.

The counsel for the defendant has no objection. 8.

The compromise arrived at between the parties is found to be lawful and is allowed.

9.

The application is disposed of.

A decree is passed in terms of IA No.1497/2018 and the Settlement Agreement annexed thereto, leaving the parties to bear their own costs. 11.

Decree sheet be drawn up.

IA No.1497/2018 with the Settlement Agreement annexed to form part of the decree sheet.

13.

A certificate entitling the plaintiff to refund of the court fees paid on the suit, less Rs.20,000/-, be issued and handed over to the counsel for the plaintiff.
