% 16.04.2018 I.A.4877/2018 in CS(COMM) 548/2017 Present application has been filed by the defendant for condonation of delay in filing the written statement.

In the present application, it has been averred that before the time expired, the father of the defendant unfortunately expired. It is further stated that thereafter the father of the Advocate expired. Keeping in view the aforesaid reasons, the delay in filing the written statement is condoned and the same is taken on record. Accordingly, present application stands disposed of. I.A.2724/2018 in CS(COMM) 548/2017 Keeping in view the report of the second Local Commissioner, learned counsel for plaintiff wishes to withdraw the present application.

Consequently, the same is dismissed as withdrawn. I.A.9504/2017 in CS(COMM) 548/2017 With consent of parties, the ex parte ad interim injunction order dated 23rd August, 2017 is confirmed till the disposal of the present suit. Consequently, present application stands disposed of. CS(COMM) 548/2017 At this stage, learned counsel for defendant states that the defendant has no objection if the present suit is decreed in terms of para 37(A) of the plaint.

Learned counsel for plaintiff states that in view of the aforesaid, he does not wish to press for any other or further relief. Consequently, the present suit is decreed in accordance with para 37(A) of the plaint. No orders as to costs. Registry is directed to prepare a decree sheet accordingly.

Registry is also directed to issue to an authorised representative of the plaintiff a certificate authorizing it to receive back from the Collector half the amount of the Court fee paid by it in the present suit. MANMOHAN, J APRIL 16, 2018 js
