After some arguments, the learned counsel appearing for the petitioner seeks to withdraw the present petition with liberty to file appropriate proceedings for enforcement of the Merger Agreement dated 14.12.1996. He further states that the delay in preferring such proceedings may be condoned.

The petition is dismissed as withdrawn.
