By way of this writ petition, the petitioner is praying for quashing of case FIR No.628/2015 under Sections 323/354/392/506/34 IPC, PS Palam Village on the basis of settlement arrived at between the parties. 2.

On the last date of hearing it was informed by learned ASC for the State that in the above noted FIR one Vinod Kumar, who was teacher in the Tuition Centre, was also assaulted but he has not been impleaded as a party in this petition.

Thereafter, the petitioner was directed to take necessary steps for impleadment of injured Sh.Vinod Kumar and upon filing the amended memo of parties within one week, notice was directed to be issued to respondent No.2 as well as to the newly added respondent namely Vinod Kumar for today.

Today the petitioner is not present. Though amended memo of parties has been filed by impleading injured Vinod Kumar as respondent No.3 but notice could not be issued to respondent Nos.2 and 3 as process fee was not filed.

Since the petitioner is not appearing before the Court despite ample opportunities being given and even steps for service of respondent Nos.2 and 3 not taken, the petition is dismissed with liberty to the petitioner to approach the Court as and when the parties are available. PRATIBHA RANI, J.
