% 12.09.2017 Learned counsel for the respondent who appears on advance notice submits that this Court will have no territorial jurisdiction to entertain the present writ petition.
Learned counsel for the respondents also state that without prejudice to the aforesaid contention, he has obtained instructions and has been asked to state that the statutory petition under Section 119 of the Coast Guard Act, 1978 is pending before the Director General and would be disposed of within five weeks from today. Counsel for the petitioner has made a submission with regard to the non-supply of documents relating to summary trial/prosecution. Counsel for the respondent, on instructions, states that this may not be correct, but the petitioner would be furnished a copy of the summary trial proceedings within a period of one week.
In case, the petitioner so desire, he will be at liberty to make a further representation within a period of five days, thereafter. Learned counsel for the petitioner submits that in view of the statement made, the present writ petition may be disposed of with liberty to the petitioner to challenge the final order, if need arises. Ordered accordingly.
