O R D E R

This order is in continuation of the earlier order dated 13th November, 2018.

The counsel for the defendants appears.

The counsels state that the dispute subject matter of the suit has been amicably resolved and a Settlement Deed dated 26th October, 2018 signed by both the plaintiffs and all the four defendants has been filed along with IA No.188/2019 under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 (CPC).

It is also stated that certain pages of the plaint as filed in this Court were found missing and an amendment application has also been filed to cure the said defect.

IA No.14414/2018 under Order VI Rule 17 of the CPC is allowed and disposed of.

The amended plaint filed with the application is taken on record. 7.

I have perused the settlement/compromise as contained in the Settlement Deed aforesaid. The same is found to be lawful. 8.

A decree is passed in favour of the plaintiffs and against the defendants in terms of IA No.188/2019 and the Settlement Deed annexed, leaving the parties to bear their own costs.

Decree sheet be drawn up.

10.

The counsel for the plaintiffs seeks refund of court fees. 11.

A Certificate entitling the plaintiffs to get refund of court fees paid less Rs.30,000/- be issued and handed over to the counsel for the plaintiffs. RAJIV SAHAI ENDLAW, J.
