After some arguments, learned counsel for the petitioner does not press the present petition. However, he submits that trial court may be directed to pre-pone the date of hearing and decide its application.

Learned counsel for the respondent has no objection. 3.

In view of the circumstance, both the parties are directed to appear before the trial court on 02.11.2018.

In the circumstance, the petition is dismissed with directions to the trial court to hear the arguments on application of the petitioner under Section 9 of the Arbitration and Conciliation Act on 02.11.2018 and decide.

The petition is disposed of accordingly along with the pending application.
