% 30.11.2018 CRL.M.A.no. 33469/2018 Allowed, subject to all just exceptions. Application is disposed of. CRL.M.C. 5057/2018 It is submitted that petitioner and respondent no.2 are brothers. They have settled their disputes amicably, therefore, aforesaid FIR No. 18/2018 under Section 308 IPC registered at police station Kirti Nagar may be quashed.
Respondent no.2 is present in Court and has been identified by ASI Tarsem Lal of police station Kirti Nagar. He submits that he has settled the matter with the petitioner of his own free will and without any undue force,
pressure or coercion, and has no objection in case the FIR is quashed against the petitioner.
Keeping in mind the settlement arrived at between the petitioner and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
