Learned counsel for the petitioner admitted that the judgment has already been passed in the matter by the Trial Court and the petitioner has already been convicted by the Trial Court and the appeal is pending before the Appellate Court. 2.

Learned counsel for the respondent No.2 submitted that in view of the aforesaid facts, the present petition has become infructuous and the petitioner can raise all the contentions before the Appellate Court in accordance with law.

Learned counsel for the petitioner submitted that he may be allowed to withdraw the petition with the liberty to raise all the contentions including the validity of the present two impugned orders dated 14.5.2018 and 16.8.2018 before the Trial Court, as per law. 4.

Accordingly, the petition is dismissed as withdrawn with the

liberty as prayed for subject to just exceptions. Pending applications are also dismissed as withdrawn.
