O R D E R

% 09.01.2020 The present petition has been filed challenging the order dated 23rd July, 2018 by which the Petitioner's application under Order IX Rule 9 CPC along with an application under Section 5 of the Limitation Act was dismissed.

The petition has been filed by Mr. Raghuvir Dongre, son of Mr. R.N. Dongre, against his mother, sister and brother, in respect of the estate of his father. Ld. counsel for the Petitioner fairly concedes that even on an earlier occasion, the petition had been dismissed. Thereafter, the present application was moved for restoration. Considering that the petition is only for grant of a succession certificate and, as per the ld. counsel, the Respondents would not be objecting to the same, the petition is restored to be listed before the ld. ACJ. After issuing notice to the Respondents i.e., the other legal heirs, or upon their filing No Objection Certificates, the petition shall be heard and

disposed of in accordance with law.

With these observations, the petition and all pending applications are disposed of.
