% 30.11.2018 1.

Pursuant to the last date of hearing, a fresh status report has been filed by the State wherein it is stated that the addresses furnished by the respondent No.4/Bhagwan Swaroop and Ms. Arti Mishra, daughter of the petitioner, have been verified. It is stated that out of the two addresses furnished, on visiting the one at Village Sangri, District Baduan, U.P., the locals had informed the police that the respondent No.4 and his wife have not been residing at the said address and that they, seldom come to village. The statement of Smt. Satwati, mother of the respondent No.4 and the other villagers were also recorded. At the second address at Ghaziabad, U.P., Ms. Meena Devi, sister of the respondent No.4 was found. On enquiring, she had W.P.(CRL) 3094/2018

stated that her brother and Ms. Arti Mishra had been residing with her for about three months. The couple was also found present there. 2.

The petitioner and respondent No.4 as also Ms. Arti Mishra are present in the Court.

4.

We may note that on the last date of hearing, we had extensively interacted with all the parties but Ms. Arti Mishra had point blank refused to even meet her parents. Today, we have yet again asked Ms. Arti Mishra if she is willing to meet her parents, who are present in Court. She agreed but after a couple of minutes, while we are still in the process of dictating the order, both the parties are back. Ms. Arti Mishra states she is unwilling to meet her parents and wishes to reside with the respondent No.4. 5.

In view of the fact that Ms. Arti Mishra had appeared in Court on the last date and today, no further orders are required to be passed on this petition for issuance of a writ of habeas corpus. 6.

The petition is disposed of.
