HON'BLE MR. JUSTICE A.K. PATHAK

% 12.11.2018 Notice. Learned APP accepts notice on behalf of respondent no1. Learned counsel for respondent no.2 also accepts notice. Petitioner has prayed for quashing of FIR No.1793/2015 under section 135 of Electricity Act registered at police station Neb Sarai on the complaint of respondent no.2, on the ground that matter has been settled with the respondent no.2, in as much as settled amount has already been paid. Learned counsel for respondent no.2 admits the factum settlement. He says that settled amount has also been received, therefore, respondent no.2 has no objection in case the aforesaid FIR and consequent proceedings emanating therefrom, are quashed.
Keeping in mind the settlement arrived at between petitioner and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.
Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed against the petitioner.
Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J NOVEMBER 12, 2018/sm
