% 19.09.2017 Learned counsel for the petitioner submits that petitioner is in Judicial Custody for more than three years. Petitioner has not been identified by the complainant in Court.
There is nothing against the petitioner except the disclosure statement of the co-accused. Robbed articles have also not been recovered from the petitioner.
As per the prosecution, petitioner used to give information about the movement of the complainant. Learned APP submits that appellant had given information about the movement of the complainant to Ashok Kumar and Tarun and in turn Tarun and Ashok Kumar passed on the information to Harcharan. On the basis of this information, complainant was robbed by accused Avtar Singh, Gurjeet
and Anil Luthra.
It is further submitted that co-accused had looted the jewellery from the complainant.
Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
