1. The stay order is vacated and the application is disposed of. CM APPL. 8189/2019 in FAO(OS) (COMM) 231/2018

2. It is stated that the parties have settled their disputes and the Respondents has agreed to receive a sum of Rs. 1 crore in full and final settlement of all it claims against the Appellant. The schedule of payments has been set out in para 4 of the application. The application has been signed by both parties.

3. It has been stated in para 5 that in case of failure/default of the Appellant for these payments by the Appellant would be liable to pay the total awarded amount to Respondent after adjusting the instalments made by them.

4. In terms of the schedule of payments set out in para 4 of the application, post dated cheques have been handed over by counsel for the Appellant to learned counsel for the Respondent.

5. The parties are bound by the terms of settlement as set out in the application. The application is disposed of

6. The appeal FAO (OS) (COMM) 231 of 2018 is also disposed of in terms of the settlement.
