% 31.08.2016 None has appeared for the petitioner.

The petitioner is aggrieved by the fact that this application seeking allotment of an alternate plot had been rejected vide communication dated 19.08.2014 only for the reason that the application dated 08.07.2003 had not been signed by the natural guardian. Submission of the petitioner (as is clear from the averments in the writ petition) is that this was no correct and this is too technical reason and moreover, it was only due to oversight that this application was not signed by the natural guardian. Even otherwise, it is not the case of the respondents that the application was unsigned. Record also confirms that the application filed by the petitioner on 22.09.2003 was within time.

The case of the petitioner be considered on merits. The order dated 19.08.2014 is set aside.

At this stage, it is pointed out by the respondent that the petitioner has now become major.

On the petitioner presenting an application in its appropriate format to the Department, the Department will consider the case of the petitioner on merits and the same shall be done as per seniority in terms of his earlier application dated 08.07.2003. The case of the petitioner be decided in a time bound frame of four months from today.

Petition disposed of.
