% 05.10.2018 Learned counsel for petitioner submits that the police had arrived at the spot immediately after the incident. Allegations against the petitioner are that he fired in the air, however, no cartridge was recovered from the spot despite the fact that PCR had reached the spot immediately after the incident.

Learned APP, on instructions, submits that petitioner has joined investigations. Learned APP, however, opposed grant of anticipatory bail to the petitioner on the ground that the allegations levelled against him are of serious nature.

Keeping in mind the totality of facts and circumstances of this case, it is ordered that in case of arrest, petitioner be released on bail subject to his furnishing a personal bond in the sum of `10,000/-

(Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO concerned.

Bail application is disposed of in the above terms.

Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J OCTOBER 05, 2018 sm
