After arguments, the appeal is disposed of as not pressed as counsel for the appellant says that the appellant intends to invoke the right of pre-emption as provided under Section 22 of the Hindu Succession Act, 1956.

Accordingly, this appeal is disposed of by giving liberty to the appellant to apply for his rights in the final decree proceedings in accordance with Section 22 of the Hindu Succession Act read with the similar provisions under the Partition Act, 1893. 3.

The appeal is accordingly disposed of, but with the aforesaid liberty.
