O R D E R

% 08.02.2018 Vide the present petition, the petitioner had prayed for a direction to quash the communications dated 04.08.2017 and 05.08.2017 issued by the respondents whereby the petitioner had been declared ineligible to contest in the election for the post of President in the Fencing Association of India (FAI) which was held on 20.08.2017. The petitioner had also prayed for other connected reliefs relating to the same elections.

Though process fee for issuance of notice to respondent nos.2 to 4 was not filed, learned counsel for the petitioner submits that since no interim orders had been passed by this Court, the elections of FAI have been held on 20.08.2017 and office bearers of the Association stand elected. Learned counsel for the petitioner submits

that it has therefore, become necessary to challenge the said elections and therefore, instead of pursuing the present petition, she may be granted leave to withdraw the present petition with liberty to file a fresh petition challenging the aforesaid election on all available grounds including the grounds taken in the present petition. The petition is dismissed as withdrawn. Liberty prayed for is granted. The pending application stands disposed of. REKHA PALLI, J FEBRUARY 08, 2018 gm
