% 17.07.2017 Since I.A.No.14372/2016 is the fourth amendment application in the present suit, learned counsel for the defendant states that the defendant is unable to make out as to what portion of the plaint is being amended.

This Court finds merit in the contention advanced by learned counsel for the defendant.

Consequently, the present suit and the pending application are disposed of with liberty to the plaintiff to file a fresh suit on the same cause of action.

The registry is directed to issue a certificate authorizing the plaintiffs to receive back from the Collector the entire amount of Court-fee paid by them in respect of the present suit. MANMOHAN, J JULY 17, 2017/KA
