The instant petition has been filed by the petitioner praying for consolidation of three cases between the parties pending in different courts i.e. Eviction Petition No.62/2009 titled as S.Daya Singh vs. S.Pritam Singh & Ors.' pending in the Court of Kiran Gupta, ARC, Patiala House Court, Delhi; Suit No.724/2013 titled as 'Everett Travel Service vs. S.Harisimran Singh & Ors.' pending in the Court of Ms.Aanchal, Civil Judge, Tis Hazari Court, Delhi; and CS No.116/2015 titled as 'Everett (India) Private Ltd. Vs. Gurpal Singh & Ors.' pending in the Court of Ms.Kiran Gupta, ARC, Patiala House Court, Delhi.

Learned counsel for respondent No.1 submits that out of the three cases mentioned above, two cases i.e. Eviction Petition No.62/2009 titled as 'S.Daya Singh vs. S.Pritam Singh & Ors.' and CS No.116/2015 titled as TR.P.(C.) 54/2015
'Everett (India) Private Ltd. Vs. Gurpal Singh & Ors.' have already been decided and as on date only one case i.e. Suit No.724/2013 titled as 'Everett Travel Service vs. S.Harisimran Singh & Ors.' is pending. 3.
In view of the submissions made by learned counsel for respondent No.1, since as on date only one case is pending out of the three cases, consolidation of which has been sought by the petitioner by filing this transfer petition, the very foundation of this transfer petition ceases to exist. 4.
In the circumstances, the transfer petition is dismissed for having become infructuous.
