O R D E R
% 29.11.2018 After certain discussions, learned counsels for parties have amicably settled the matter and it is agreed the petitioner shall not challenge the impugned judgment on merits, if granted some more time to vacate the premises.
The learned counsel for the respondent agrees for giving two more years to the petitioner if he makes payment of user charges @ Rs.32,500/- per month.
In the circumstances, the order of eviction shall not be enforceable till 30.11.2020 provided the petitioner regularly pays an amount of Rs.32,500/- p.m. as user charges w.e.f. 01.12.2018 payable on 7th day of each month, besides water and electricity charges as per actual and shall hand over such receipts to the respondent on or before vacation of the premises.
The pending litigations, if any, shall also be withdrawn by respective parties and the respondent shall not interfere in the peaceful enjoyment of the premises by the respondent for above said period. The petitioner may repair the premises qua any seepage etc if any at own costs.
The petitioner shall file an undertaking to the above effect within a week from today with an advance copy thereof to the learned counsel for the respondent.
The petition stands disposed of in above terms. The pending application also stands disposed of.
