% 06.12.2018 Notice. Learned APP for State accepts notice. Respondent No. 2/Smt. Savita @ Neeta is present in court along with her counsel. Petitioner No. 1 is present in court and has paid the costs of `5,000/- (Rupees Five Thousands) imposed vide order dated 16.10.2018 to the respondent No. 2 in the court today. Respondent No. 2 states that she has settled the matter with the petitioner No. 1 of her own free will and without any undue force, pressure or coercion in the Family Court, South East District, Saket, New Delhi on 14.10.2017.
She states that her marriage with the petitioner No. 1 has already been dissolved by Decree of Divorce dated 31.01.2018.
Petitioner has paid `2,00,000/- (Rupees Two Lacs) to
respondent No. 2 vide demand draft, photocopy thereof has been placed on record. Respondent No. 2 states that the entire settlement amount of ` 5,50,000/- (Rupees Five Lacs and Fifty Thousands) has been paid by the petitioner and she has no objection, in case FIR No. 0081/2016, registered under Sections 498-A/406/34 IPC at P.S. Lodhi Colony, Delhi is quashed against the petitioner No. 1 and his relatives, that is petitioner Nos. 2 to 5.
Keeping in mind the settlement arrived at between the petitioner No. 1 and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending.
Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application, if any, is disposed of as infructuous. Dasti. A.K. PATHAK, J.
