O R D E R

% 11.03.2016 The present petition has been filed under Section 397 Cr.P.C. seeking to set aside the order dated 29.05.2015 passed by the learned ASJ in SC No.1/3/2015. Vide said order, charge has been framed against the petitioners under Section 498A/34 IPC and under Section 302/34 IPC and in alternative under Section 304/34 IPC. The only grievance of the petitioners is that the order of framing charge against the petitioner under Section 302/34 IPC will cause prejudice to the petitioners at the time of consideration of bail application, if any, moved by them.

Keeping in view the submission made, the present petition is disposed of with the observation that the Trial Court while considering the bail application, if any, of the petitioners for grant of bail shall decide the same on merit rather than giving regard to the sections under which charges have been framed against the petitioners.
