% 04.01.2016 I.A. No.24250/2015 (u/o IX R.7 CPC for setting aside the order dated 11th August, 2015) and I.A. No.24252/2015 (for condonation of delay in filing the application under Order IX R.7 CPC), by defendants The plaintiff filed the suit for specific performance of agreement dated 25th October, 2013.

As the defendants did not appear after receiving the summons, they were proceeded ex-parte on 11th August, 2015.

Thereafter the defendants moved the above mentioned applications.

Notice was issued in the applications.

Replies have not been filed.

The valuation of the suit is Rs.70,00,000/-. In view of Section 4 of the Delhi High Court (Amendment) Act, 2015 and the order passed on 24th November, 2015, the suit is transferred to the jurisdiction of District Judge (North-West), Rohini Court, Delhi. Parties to appear before the concerned Court on 28th March, 2016. In the meanwhile, the plaintiff is granted six weeks time to file replies to the applications.

As there is no appearance on behalf of the plaintiff or his

counsel, the Registry to issue the Court notice, without process fee, to the plaintiff as well as through counsel for the next date for their appearance before the Transferee Court.

Learned counsel for the defendants will also inform the learned counsel for the plaintiff about the orders passed by this Court through Regd. post. The date fixed before the Joint Registrar on 5th January, 2016 is hereby cancelled. The matter be not listed on the said date. MANMOHAN SINGH, J.
