% 18.05.2016 The present petition has been filed under Section 482 Cr.P.C. seeking to set aside the order dated 02.03.2015 passed by the Revisional Court.
The sole ground raised by the learned counsel for the petitioner is that the Revisional Court vide its order dated 02.03.2015 set aside the order on charge framed by the Trial Court vide order dated 27.10.2014 and modified the order.
The admitted position is that before the Revisional Court neither the petitioner was a party nor was he afforded an opportunity
to present his case.
In the given facts and circumstances, the order dated 02.03.2015 is set aside and the matter is remanded back to the Revisional Court to decide the Revision Petition afresh after an opportunity of hearing to the petitioner.
The parties are directed to appear before the Revisional Court on 14.07.2016.
