% 30.11.2018 CRL.M.(BAIL) 1770/2018 and CRL.M.A. 47342/2018 Learned counsel for the petitioner submits that the present bail application be treated as an application for interim bail on medical grounds.
Admittedly the petitioner is suffering from Multi Drug Resistant Pulmonary Tuberculosis (MDR-TD). A perusal of medical report dated 27th November, 2018 submitted by the jail doctor shows that the condition of the petitioner is not good. The relevant para of report reads as under:- "That the petitioner is admitted in TB Ward of Central
Jail Hospital. He has complains of persisting cough with sputum with bleeding in sputum, difficulty in breathing with pain and weakness in both lower limbs with decreased appetite with pain and discharge from wound in right side of chest.
All the medicines are being provided to him from Jail Hospital itself. His symptoms are persisting in nature and improvement is not satisfactory."
Keeping in view the medical condition of the petitioner, it is ordered that he be released on interim bail for a period of three months from the date of his release subject to his furnishing a personal bond in the sum of `25,000/-(Rupees Twenty Five Thousand Only) with one surety of the like amount to the satisfaction of the Trial Court. Bail application is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
