% 29.10.2018 Instead of approaching this Court for the relief claimed in this petition, petitioner ought to have approached the court where civil suit No.1258/2017 titled Saurabh Kumar v. Naveen Kumar Jain and Ors. is pending as the appellate court vide order of 18th September, 2017 has passed interim orders in the pending suit.

In view of aforesaid, while refraining to entertain this petition, liberty is granted to petitioner to approach the trial court/appellate court. This petition and the application are accordingly disposed of with liberty as aforesaid.
