CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 08.10.2018 Notice. Learned APP accepts notice. Respondent nos.2 and 3 namely Sarfaraz Khan and Salman Khan are present in Court along with their counsel, who accept notice. They have been identified by SI Rahul Kumar of police station Shakarpur. Respondent nos. 2 and 3 submit that they received simple injury in the incident and they have now settled the matter with the petitioners of their own free will and without any undue force, pressure or coercion in terms of Memorandum of Understanding dated 4th June, 2018. They have no objection in case FIR No.1143/2015 under sections 308/34 IPC registered at police station and the consequent proceedings are quashed against the petitioners.

Keeping in mind the settlement arrived at between the accused persons (petitioners) and complainants voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J OCTOBER 08, 2018/sm
