versus STATE (NCT OF DELHI) ..... Respondent Through Ms. Rajni Gupta, APP for the State.

SI Rakesh PS Sarita Vihar.

CORAM:

HON'BLE MR. JUSTICE ASHUTOSH KUMAR

O R D E R

% 18.12.2015 The petitioner, who is the husband of the complainant, has sought bail in anticipation of arrest in connection with FIR No.229/2015 (PS Sarita Vihar) instituted for offences under Sections 498-A/406/34 of the IPC.

By order dated 05.08.2015, the case of the petitioner and the respondent was sent to the Delhi High Court Mediation Centre (SAMADHAN).

At the mediation centre, the parties settled their differences and agreed to part ways amicably. The terms of settlement delineates the specific obligations which are required to be performed by both the parties for divorce and for payment of all matrimonial dues.

Considering the fact that now the dispute stands resolved and there is every likelihood of the FIR being quashed, this Court is

inclined to grant anticipatory bail till the time the entire process is not complete.

In the event of arrest, the petitioner shall be enlarged on bail on his furnishing a bond in the sum of Rs.5,000/- with one surety of the like amount to the satisfaction of the investigating officer/SHO of the concerned police station.

The application is allowed and disposed of accordingly. ASHUTOSH KUMAR, J DECEMBER 18, 2015 ab
