None appear for the petitioners.

The petitioners have filed the present petition, inter alia, praying that the respondents be punished under the Contempt of Courts Act, 1971, for violating the order dated 14.09.2018 passed by the Coordinate Bench of this court in a writ petition (captioned Ratnesh Kumar & Ors. v. Board of Directors, Dena Bank and Ors., bearing W.P.(C) 9709/2018) 3.

The petitioners are Senior Managers working in Dena Bank Ltd. and were posted in the Delhi Zone at the material time. The said petitioners were transferred from Delhi and the said transfer orders were impugned by way of filing the aforesaid writ petition (W.P.(C) 9709/2018). The said petition was moved on 14.09.2018 and a Coordinate Bench of this Court had issued notice as to why rule nisi be not issued. It is stated that in the meanwhile, Dena Bank has issued orders, relieving the petitioners from their posts and

advising them to report to the Surat Zone. According to the petitioners, this is in violation of the orders passed by this Court on 14.09.2018 and, therefore, such action warrants imposing punishment under the Contempt of Courts Act, 1971.

The aforesaid contention is unmerited as no stay was granted by this Court on 14.09.2018, and there was no order restraining Dena Bank from proceeding further with the transfer orders. The petition is bereft of any merit.

It is, accordingly, dismissed both for non-prosecution, as well as being unmerited. The pending application also stands disposed of. VIBHU BAKHRU, J FEBRUARY 28, 2019 MK
