The affidavit of the Deputy Commissioner of Police (North-West District) dated 20.09.2017 has been filed. It contains details of the investigation from the date of incident till 06.09.2017. 2.
It is submitted by learned standing counsel that initially the matter was investigated by the Investigating Officer of PS Bharat Nagar, Delhi and the 'Action Taken Report/Status report' was filed before the learned ACMM, Rohini Courts, Delhi.
However, the Deputy Commissioner of Police transferred the investigation to the District Investigation Unit (DIU) of North-West District by order dated 27.03.2017. He submits that the IO of the DIU filed the status report dated 20.07.2017 on similar lines before the learned ACMM, Rohini Courts, Delhi and for this reason the DCP concerned had issued a show cause notice to the IO and he has been
removed from the investigation of the case.

In the affidavit, it is mentioned that the State has no objection if the investigation is transferred to the Crime Branch of Delhi Police. Learned standing counsel submits that in view of the affidavit of the DCP concerned, the further investigation may be transferred to the Crime Branch of Delhi Police.

In these circumstances, the further investigation of FIR No.233/2016 dated 24.04.2016 under Section 302/394 of IPC registered with PS Bharat Nagar, North-West District, Delhi is ordered to be transferred to the Crime Branch of Delhi Police, which shall be under the supervision and monitoring of ACP (Crime Branch) of Delhi Police.

The petition is disposed of accordingly.
