% 13.10.2017 Ms. Pooja Gupta, respondent no.2 is present in Court alongwith her counsel and has been identified by W/ASI Roshni Sharma. She says that she has settled the matter with the petitioner before the Mediation Centre, Karkardooma Courts on 3rd August, 2016. She further submits that her marriage with the petitioner has already been dissolved by a decree of divorce by mutual consent passed by the Family Court, West District, Tis Hazari Courts, Delhi on 11th April, 2017. She submits that she has settled the matter with the petitioner of her own free will and without any undue force, pressure or coercion.

Petitioner has paid `30,000/- to the respondent no.2 vide demand draft, photocopy whereof has been placed on record. Respondent no.2 submits that the entire settled amount stands paid with this payment.

Respondent no.2 submits that in view of the settlement arrived at with the petitioner before the Mediation Centre, she is not willing to pursue criminal proceedings against the petitioner and she has no objection if the FIR is quashed. Keeping in mind that marriage between the petitioner and respondent no.2 has already been dissolved by mutual consent and respondent no. 2 is not willing to pursue the FIR any further, in the interest of justice, FIR No. 42/2012 under Sections 498-A/406/34 IPC registered at police station Crime (Women) Cell and the consequent proceedings emanating therefrom, are quashed.
