% 11.10.2017 None has appeared for the respondent. None had appeared for the respondent on the last date. Service has been effected on the sole respondent.

Record shows that the petitioner is a public trust. It had applied to the State Government for starting a B.Sc (Nursing) course for the academic year 2017-18. It was granted No Objection Certificate from the State Government. It thereafter applied for B.Sc (Nursing) course to the respondent for the aforenoted academic year on 14.11.2016. His application was accepted which was later on converted from status of 'accepted' to 'rejected'. Petitioner is aggrieved by the last communication of the respondent dated 02.08.2017. Submission is that his application which was rejected was for an arbitrary reason.

The communication dated 02.08.2017 has been perused. This communication clearly informs the petitioner to submit a fresh proposal with a duly registered Trust Deed, in order that the proposal could be considered and necessary action could be taken. Admittedly, after 02.08.2017 no fresh proposal has been submitted by the petitioner.

This court is of the view that this petition is not maintainable. It is dismissed. Learned counsel for the petitioner is, however, granted liberty to approach the Nursing Council with a fresh proposal in terms of the communication dated 02.08.2017 and the submission of the petitioner that his Trust Deed already stands registered shall be considered by the respondent. The proposal shall be decided positively by the respondent within an outer limit of 6 weeks. Petitioner disposed of in the above terms.
