% 08.10.2018 Vide order of 17th April, 2018, stay was granted while entertaining petitioner's revision petition and the said interim order was continued on 10th May, 2018, but on 13th September, 2018, it was vacated by way of a cryptic order. Petitioner had sought restoration of the stay, which also stands declined vide impugned order of 20th September, 2018, which is also a cryptic order.
No reasons are forthcoming as to why the interim order has been vacated. Principles of natural justice require that reasons ought to be spelt out, particularly for vacating an interim order. Impugned order of 20th September, 2018 is set aside so far as it refuses to restore the interim order.
Learned counsel for petitioner submits that the matter is coming up before the Financial Commissioner, Delhi on 23rd October, 2018. Let petitioner be heard afresh on his application for restoration of W.P.(C) 10729/2018
stay and a speaking order thereon be passed by the Financial Commissioner, Delhi. Till it is so done, interim order of 17th April, 2018 shall continue to operate.
With aforesaid directions, this petition and the application are disposed of.
