The petitioner has filed the present petition impugning a notification dated 07.09.2018 (S.O. 4616 (E)) prohibiting the manufacturing, sale and distribution for human use of Fixed Dose Combination (FDC) of Paracetamol + Caffeine + Phenylephrine + Chlorpheniramine . 4.

Mr Kirtiman, Singh, learned counsel appearing for the respondent states that the impugned notification needs to be rescinded as it falls under list of FDC's that were approved prior to the year 1988 provided by the

counsel in the Supreme Court of India.

In view of the above, the present petition is allowed and it is directed that the impugned notification be treated as rescinded. The pending application is also disposed of.
