Learned APP contends that the contention of the petitioner that surgery could not be performed on 16.08.2018 since his wife was suffering from Dengue or the surgeon was not available has not been found to be correct.

Learned counsel for the petitioner accordingly seeks leave to withdraw the petition.

Petitioner was granted interim bail by order dated 13.08.2018 in Bail Appln No.1844/2018 for a period of two months. In terms of order dated 13.08.2018, Petitioner was to surrender on 15.10.2018. Time to surrender was extended till today. Since it is already 6 PM, petitioner is directed to surrender before the concerned jail authority tomorrow i.e. on 17.10.2018. 4.

Petition is dismissed as withdrawn, however with the above directions.
