After making some submissions, Mr.Chander Lall, learned Senior counsel for the appellant, seeks permission to withdraw the appeal and challenge the impugned order by filing Regular First Appeal. 2.

In the circumstances, the appeal is dismissed as withdrawn with such liberty.

However, the protection granted by this Court by order dated 10.10.2018 shall continue to operate for 10 days to enable the appellant to avail such remedy.

In view of above, the application, being CM No.42418/2018, is also dismissed as withdrawn.
