% 22.09.2017 The counsel submits, on instructions, that he may be allowed to withdraw the present appeal and instead file a review petition as evidence had been adduced before the tribunal to press for the income of the deceased boy aged 17 years to be notionally assessed at considerations higher than the income ordinarily assumed in terms of Section 163-A of the Motor Vehicles Act, 1988, but such evidence was not considered. The appeal along with pending applications is dismissed as withdrawn with liberty as prayed for.
