O R D E R

% 23.01.2018 This petition under Section 11 of the Arbitration & Conciliation Act, 1996 has been filed by the petitioner seeking appointment of an Arbitrator to adjudicate the disputes that have arisen between the parties in relation to the Loan Agreement dated 19.07.2015. The Loan Agreement contains an Arbitration Agreement in the form of Clause 9.7 thereof. Though reply has been filed by the respondents to the said petition raising various pleas, learned counsels for the respondents submit that they have no objection if the parties are referred to Delhi International Arbitration Centre (DIAC), who may appoint a Sole Arbitrator to adjudicate the disputes between the parties in relation to the above mentioned Loan Agreement.

In view of the above, parties are directed to appear before DIAC on

20th February, 2018 at 3.00 p.m. DIAC shall appoint the Sole Arbitrator for adjudicating the disputes between the parties. The arbitration and the fee shall be governed by the rules of the DIAC.

The petition is allowed with the above directions. Dasti.
