% 06.02.2019 The petitioner vide the present petition assails the order dated 13.11.2017 of the Court of the Civil Judge-08 (Central), Tis Hazari Courts, Delhi, in suit No. 93866/16 (Old No. 633/17) vide which applications under Order I Rule 10 Code of Civil Procedure, 1908 and under Order 6 Rule 17 Code of Civil Procedure, 1908 filed by the plaintiff i.e., the petitioner of the present petition, were declined. When the proceedings were taken up on 23.10.2018 before this Court it was indicated that the matter was listed for preliminary hearing for today i.e. 6.2.2019 and in the meanwhile, the petitioner was directed to inform the respondent about the the next date of hearing with it having been clarified that there was no stay of the Trial Court proceedings.

A report in the form of a letter of the learned Civil Judge-08 (Central) dated 1.11.2018 has been received which indicates that the

said suit has already been dismissed vide the judgment and decree dated 23.10.2018 itself i.e., the date on which the matter had been taken up by this Court with it having been clarified that there was no stay of the Trial Court proceedings.

The petition is dismissed as infructuous and apparently calls for no further action.
